The Civil Guard investigates a driver who collided with another passenger car when he was driving in the opposite direction, quadrupling the maximum alcohol rate (16/10/2020)

The 53-year-old male driver, of Bolivian nationality and a resident of Murcia, has been investigated as the alleged perpetrator of three crimes against road safety for reckless driving, under the influence of alcoholic beverages and having a temporary suspension of the driving license in force. The investigation began when the Traffic Operational Center (COTA) of the Murcia Civil Guard Traffic Sector / Subsector was alerted to a traffic accident, at kilometer 588,450 of the A-7 highway (Tarragona-Algeciras) , municipality of Librilla, in which two vehicles were involved. A motorcyclist patrol from the Murcia Traffic Detachment verified that it was a side collision between two passenger cars, in which there had only been material damage to the vehicles, without any of the drivers being injured. The civil guards verified that the accident occurred when one of the cars improperly entered the highway through the access lane to the road towards Almería, along which it circulated around 500 meters in the opposite direction. The driver was subjected to the mandatory breathalyzer tests in which he gave a positive result of 1.04 and 1.06 milligrams of alcohol per liter of exhaled air, quadrupling the maximum allowed rate of 0.25 mg / liter. Other checks made it possible to find out that this person had a judicial order of temporary suspension of his driving license in force, until next November, for the commission of other crimes against road safety. The person under investigation, who is allegedly responsible for three crimes against road safety for driving in a manifestly reckless manner, specifically endangering the life or integrity of other users, driving under the influence of alcoholic beverages and deprivation of the driving license By court order, it has been made available to the Investigating Court number 1 of Totana. The two vehicles involved in the accident were withdrawn by roadside assistance services and the one under investigation was brought to justice. The investigated person, along with the proceedings, have been made available to the Investigating Court number 1 of Totana (Murcia). The crime of reckless driving is contained in article 380 of the Penal Code and can be punished with prison terms of 6 months to 2 years and deprivation of the right to drive motor vehicles and mopeds for a time greater than 1 and up to 6 years. On the other hand, the crime of driving under the influence of alcoholic beverages is included in article 379 of the Penal Code and can be punished alternatively with prison terms of 3 to 6 months, a fine of 6 to 12 months, or work in benefit of the community from 31 to 90 days and in any case with deprivation of the right to drive motor vehicles and mopeds for a time greater than 1 and up to 4 years. Likewise, the crime of driving having been deprived of the license by judicial resolution appears typified in article 384 of the Penal Code and can be punished alternatively with prison terms of 3 to 6 months, a fine of 6 to 12 months, or work for the benefit of the community from 31 to 90 days. The Civil Guard continues to reiterate its message to those drivers who recklessly and recklessly, despite the campaigns and warnings of the General Traffic Directorate, drive after having drunk alcohol or taken drugs. On the other hand, the Civil Guard appeals to the civic conscience of the population to notify the telephone 062 (Civil Guard) or 112 (Emergencies) or directly to the patrols in service, when they encounter anomalous situations or irregular maneuvers that give rise to to think that drivers do so under the influence of drugs or alcohol, in order to be able to adopt the appropriate police measures so that these vehicles are intercepted. More than a thousand vehicles controlled on the Pilar bridge During the Puente del Pilar, from Friday 9 to Monday 12 October 2020, the Traffic Group of the Civil Guard of the Region of Murcia, in different alcohol and drug verification devices, has carried out a total of 1,262 breathalyzer tests , of which 10 had a positive result (0.79%). Three drivers have been investigated for driving under the influence of alcoholic beverages and the other seven have been reported to the Murcia Provincial Traffic Headquarters. 13 drivers have tested positive for drugs.

One of these drivers has been investigated for a crime against road safety for driving under the influence of drugs and the other 12 have been reported to the Murcia Provincial Traffic Authority.
